    By engaging with B&A Stairs, you grant us the right to photograph, record, and use media related to your project for marketing, training, promotional, and portfolio display purposes. Media may include photos, videos, and recordings captured during the course of your project, which may be used on digital platforms, print media, social media, and other forms of communication, in accordance with applicable laws.

    B&A Stairs implements industry-standard measures to protect personal data from unauthorized access, misuse, or breaches. Access to your personal information is restricted to authorized personnel who require it for operational purposes.

    We retain personal data for as long as it is necessary to fulfill the purpose for which it was collected, or as required by applicable law. Terms and Conditions

  1. General Agreement
    By accessing, using, or interacting with any B&A Stairs services, websites, digital platforms, social media channels, or any other means of communication, you agree to comply with these Terms and Conditions and our Privacy Policy. This agreement applies to all platforms and communication channels that B&A Stairs makes available for customer engagement, as allowed under applicable laws. Use of our services or engagement with our platforms implies full acceptance of and agreement to all applicable terms, conditions, and policies outlined by B&A Stairs. Continued engagement implies your acknowledgment and adherence to any updates or modifications to these terms.
  2. Scope of Services
    B&A Stairs provides a range of services, including but not limited to construction, consultation, and renovation services, which are governed by project-specific contracts. The scope and limitations of each project are defined within these contracts.
  3. Intellectual Property and Media Use
    All media, including but not limited to photos, recordings, and other documentation captured during a project, is the exclusive property of B&A Stairs. By engaging our services, you grant us a non-exclusive, royalty-free license to use project-related media for marketing, training, and promotional purposes.
  4. Confidentiality Agreement
    B&A Stairs and its representatives are committed to protecting and maintaining the confidentiality of proprietary information shared by clients, including business details, client data, and project-specific details.
  5. Limited Warranty and Disclaimers
    B&A Stairs offers a limited warranty on workmanship for a specified period following project completion. This warranty excludes normal wear and tear, misuse, unauthorized modifications, and environmental factors. All services are provided “as-is” without any implied warranties, to the fullest extent permitted by law.
  6. Liability and Assumption of Risk
    Clients assume responsibility for adhering to site safety protocols, including restricted area access and the use of protective gear. B&A Stairs is not liable for incidents arising from unauthorized access or safety protocol breaches.
  7. Refund and Cancellation Policy
    While refunds are not guaranteed, cancellation requests may be reviewed based on project-specific contracts. All outstanding payments for services rendered remain due.
  8. Force Majeure
    B&A Stairs shall not be held liable for delays or failures in performance caused by events beyond our control, including but not limited to acts of nature, labor disputes, or governmental actions.
  9. Payment Terms and Default
    Payment terms, including deposits and final payments, are outlined in the project contract. Non-compliance with payment terms may result in service suspension, penalties, or legal action.
  10. Termination Clause
    Either party may terminate the agreement with written notice, subject to terms outlined in the specific project contract. Immediate termination may occur due to a breach of material terms.
  11. Indemnification Clause
    Clients agree to indemnify and hold harmless B&A Stairs from any claims, damages, or expenses resulting from misuse, noncompliance, or breaches of these terms.
  12. Customer Responsibilities
    Clients are responsible for providing timely site access, obtaining necessary permits, and adhering to safety protocols during service engagements.
  13. Governing Law
    These Terms and Conditions are governed by the laws of the State of Arizona.
  14. No-Cost Appointment for Measurements Policy
    • Scope of Services
      B&A Stairs provides an initial no-cost consultation for potential projects. This consultation covers an analysis of project feasibility, including discussions on materials, labor, site security, tools, and machinery necessary for completion. The consultation excludes landscaping, grading, wall repairs, painting, sewer and water systems, driveways, patios, or aprons, unless specifically agreed to in a subsequent formal agreement. The Contractor reserves the right to initiate, reschedule, or terminate the consultation at their discretion without liability.
    • Customer Responsibilities
      The Customer agrees to provide unrestricted property access, relevant construction documents, and utility connections (e.g., water and electricity) during the consultation period. Permits and compliance with local building codes are the Customer’s responsibility. The Customer indemnifies B&A Stairs for any fines, penalties, or legal issues arising from non-compliance or failure to obtain required permits.
    • Consent to Data Handling and Media Use
      By requesting a no-cost appointment, you consent to data collection, recording, and photography for project-related assessments as outlined in our Privacy Policy. B&A Stairs may capture media for internal use, quality control, and promotional activities.
    • Consultation Terms and Quote Follow-Up
      Quotes will be delivered within 72 hours following the measurement appointment. Customers have 14 days to accept, decline, or modify the provided quote. Non-response within this period may be considered acceptance in accordance with Arizona law.
    • Indemnification and Liability
      During the consultation, B&A Stairs assumes no liability for property damage or injuries unless a formal agreement is executed for further project work. The consultation is non-binding unless further engagement terms are agreed upon.
    • Request Process for No-Cost Appointment
      The request for a No-Cost Appointment is initiated by signing the No-Cost Appointment Request, forming a legally binding agreement between the Customer and B&A Stairs. By signing, the Customer acknowledges and accepts all terms and policies associated with the No-Cost Appointment for Measurements. This agreement also confirms acceptance of our Terms and Conditions, including the No-Cost Appointment Policy, and consents to receive a project quote within 72 hours of measurements, with prompt feedback requested. Additionally, the Customer consents to data collection, recording, and photography as outlined in our Privacy Policy.
    • Binding Nature and Contractor Affirmation
      This policy forms part of the contractual obligations between the parties as outlined in the No-Cost Appointment Request. The Agreement, titled No-Cost Appointment Request, requires only the Customer’s signature to become legally binding and effective as of the date of signing. Upon receipt of the signed Agreement by the Customer, B&A Stairs LLC will confirm acknowledgment and mutual acceptance via email to the Customer’s provided email address, using office@bnastairs.com.
      B&A Stairs affirms that the information contained in the No-Cost Appointment Request Agreement, this policy, the Terms and Conditions, and the Privacy Policy is accurate and complete, and that it collectively forms part of the contractual obligations between the parties. The Contractor’s details are provided below as required by Arizona law for documentation purposes.
  15. Referral Program Policy
    • Scope of Program
      B&A Stairs offers a referral program available to both licensed contractors and non-contractors (general public) who refer eligible clients to the company for stair-related projects. By participating in the referral program, the Referrer agrees to the terms outlined in the Referral Agreement and acknowledges compliance with applicable terms and conditions.
    • Referral Compensation
  • Licensed Contractors: Upon successful project completion valued at $6,000 or more, licensed contractors will receive a $300 Square Digital eGift Card as compensation.
  • Non-Contractors (General Public): Upon successful project completion valued at $6,000 or more, non-contractors will receive a $150 Square Digital eGift Card as compensation.

 

  • Conditions for Referral Payouts
    Referral incentives are issued only upon successful completion and verification of referred projects meeting or exceeding a value of $6,000. B&A Stairs reserves the right to verify referral eligibility and project completion status before processing any compensation.
  • Data Use and Privacy
    By participating in the referral program, Referrers consent to the use and processing of their personal data for program administration, compensation processing, and communication purposes, in accordance with B&A Stairs’ Privacy Policy.
  • Independent Promotional Efforts
    Referrers may independently engage in lead generation or promotional activities, provided such activities align with B&A Stairs’ brand guidelines and marketing standards. These efforts are voluntary and will not be reimbursed by B&A Stairs.
  • Compliance with Marketing Guidelines
    Referrers are required to accurately represent B&A Stairs in all promotional activities. Misleading or unauthorized marketing practices are strictly prohibited and may result in termination from the referral program.
  • Termination of Program Participation
    Either B&A Stairs or the Referrer may terminate participation in the referral program at any time with written notice. Termination will not affect compensation for eligible referrals completed prior to the termination date.
  • Request Process for Participation in the Referral Program
    Participation in the B&A Stairs Referral Program is initiated by signing the B&A Stairs Referral Agreement, forming a legally binding agreement between the Referrer and B&A Stairs. By signing, the Referrer acknowledges and accepts all terms and conditions associated with the Referral Program, including but not limited to compensation eligibility, data handling as per the Privacy Policy, and compliance with marketing guidelines. This agreement also confirms the Referrer’s consent to participate in program-related communications and adhere to the brand standards set forth by B&A Stairs.
  • Binding Nature and Program Affirmation
    The Referral Program Policy forms part of the contractual obligations between B&A Stairs and the Referrer as outlined in the B&A Stairs Referral Agreement. The Agreement becomes legally binding and effective as of the date of signing by the Referrer. Upon receipt of the signed Agreement, B&A Stairs LLC will confirm acknowledgment and mutual acceptance via email to the Referrer’s provided email address, using office@bnastairs.com. B&A Stairs affirms that all information related to the Referral Program, as described in the B&A Stairs Referral Agreement, Terms and Conditions, and Privacy Policy, is accurate and forms part of the overall contractual obligations between the parties.

Terms for the Free Blueprints and Renders Offer

The following terms and conditions govern the Free Blueprints and Renders offer provided with every firepit and gabion order from B&A. This offer ensures customers have a clear understanding of their designs before production begins.

Eligibility

  • The Free Blueprints and Renders offer applies exclusively to firepit and gabion orders.
  • One blueprint and one render are included per client as part of their first order.
  • This offer is valid only once per client. For subsequent orders or additional designs, blueprints and renders will be charged at a rate of $240 per blueprint and $240 per render.

What’s Included

  • Blueprint: A detailed technical design specifying dimensions, materials, and structural details for the ordered firepit or gabion.
  • Render: A realistic visual representation of the final product to help clients preview their custom design.

Limitations

  • The offer includes one blueprint and one render per client for their initial order only.
  • Additional blueprints or renders for subsequent designs or orders will be charged at a rate of $240 per blueprint and $240 per render.
  • Free blueprints and renders are non-transferable and cannot be applied to other projects or orders.

Usage Restrictions

  • Blueprints and renders provided under this offer are intended solely for use in connection with the production of the ordered firepit or gabion by B&A.
  • Any attempt to use blueprints or renders for replication by other manufacturers is strictly prohibited and voids any associated warranty.

Ownership and Intellectual Property

  • B&A retains all rights to the designs of the blueprints and renders created under this offer.
  • These designs may be used by B&A for:
    • Future promotions or marketing purposes.
    • Resale of the same design to other clients as part of pre-designed product offerings.
  • Customers are granted limited usage rights solely for reference purposes related to their order.

Modifications

  • Clients may request up to two adjustments to the blueprint and render free of charge. Additional revisions or alternative designs will incur a design revision fee.

General Notes

  • Blueprints are required to validate warranty eligibility for firepit and gabion orders. Renders are optional and not required for warranty purposes.
  • The Free Blueprints and Renders offer is subject to the standard Terms and Conditions of B&A.

Warranty Terms

Warranty Coverage

  • Free Lifetime Warranty on Defects:
    • Automatically included with every firepit and gabion order.
    • Covers fabrication defects only, such as structural failures in welds or metal components caused by manufacturing errors.
  • Optional Paid Warranty:
    • Standard Warranty: Covers fabrication defects and materials for 1 year from the date of delivery for an additional 10% of the total price.
    • Extended Warranty: Covers fabrication defects and materials for up to 2 years from the date of delivery for an additional 5% of the total price.

What the Warranty Covers

  • Free Lifetime Warranty on Defects:
    • Applies exclusively to firepits and gabions and covers:
      • Structural failures in welds or metal components due to manufacturing defects.
      • Material defects under normal usage conditions (for Standard and Extended Warranties).
  • Standard & Extended Warranties:
    • Include the same coverage as the Free Lifetime Warranty, plus:
      • Material Coverage: Protects against material degradation or failure due to manufacturing defects for 1 year (Standard Warranty) or 2 years (Extended Warranty).
      • Proper maintenance and documentation are required to keep material coverage valid.

Requirements for Material Coverage

  • Proper Maintenance:
    • Regular maintenance must be performed as recommended to ensure product longevity and validate material coverage.
    • Customers must retain dated photographic evidence of maintenance performed, clearly showing the condition of the product and the date the work was completed.
    • Proof of Professional Maintenance: Receipts, job orders, and proof of payment for maintenance performed by a qualified professional must be provided to maintain warranty eligibility.
    • B&A Recommended Maintenance: For hassle-free eligibility, we recommend using B&A Maintenance Services, which ensure compliance with warranty requirements.

Maintenance Services

  • Optional Maintenance: Recommended every 6 months to ensure product longevity and warranty validity.
    • Maintenance Service Fee: 5% of the total price of all firepits and gabions acquired, plus any applicable travel fees for reaching and returning from the maintenance location.
    • Guaranteed Warranty Compliance: Maintenance performed by B&A guarantees eligibility for extended material coverage under the Standard and Extended Warranties.

What the Warranty Does Not Cover

  • Damage caused by:
    • Improper use (e.g., overloading gabions, burning unsuitable materials in firepits).
    • Natural wear and tear, such as rust, weather-related fading, or scratches.
    • Transport-related dents or minor handling damage.
  • Unauthorized repairs or modifications void the warranty.

Customer Responsibilities

  • Inspection: Customers must inspect the product within 48 hours of delivery and report any defects to their sales representative.
  • Maintenance Records: Customers must maintain proper documentation of maintenance to validate material warranty claims.
    • Dated photos of maintenance performed.
    • Receipts and job orders from professional maintenance services.
    • If using B&A Maintenance Services, records are automatically managed and warranty compliance ensured.

Limitations

  • Warranty claims are limited to repair or replacement of defective parts.
  • Shipping and travel fees for repairs or maintenance services are the responsibility of the customer.
  • Warranty coverage is capped at the original purchase price of the product.
